NOTICE OF INTENT TO ENACT A  LEE COUNTY ORDINANCE

 

NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Lee County, Florida will consider the enactment of a county ordinance on Tuesday, the 14th  day of June, 2011, at 9:30 a.m., in the County Commissioners= Meeting Room, Old Lee County Courthouse, 2120 Main Street, Fort Myers, Florida.  The title of the proposed ordinance is:

 AN ORDINANCE REPEALING AND REPLACING LEE COUNTY ORDINANCE NO. 00-13 AND NO. 94-27, PERTAINING TO THE TOWING OF VEHICLES PARKED ON PRIVATE PROPERTY AND THE REMOVAL OF STORAGE OF VEHICLES WITHOUT VEHICLE OWNER CONSENT; ESTABLISHING MAXIMUM RATES WHICH MAY BE CHARGED ON THE TOWING OF VEHICLES FROM OR IMMOBILIZATION OF VEHICLES ON PRIVATE PROPERTY; REMOVAL AND STORAGE OF WRECKED OR DISABLED VEHICLES FROM AN ACCIDENT SCENE OR FOR THE REMOVAL AND STORAGE OF VEHICLES, IN THE EVENT THE VEHICLE OWNER OR OPERATOR IS INCAPACITATED, UNAVAILABLE, LEAVES THE PROCEDURE OF WRECKER SERVICE TO THE LAW ENFORCEMENT OFFICER AT THE SCENE OR OTHERWISE DOES NOT CONSENT TO THE REMOVAL OF THE VEHICLE; NONCONSENSUAL TOWING APPLICATION FOR WRECKER OPERATOR'S PERMIT; IMMOBILIZATION  OPERATOR’S PERMIT; PROVIDING FOR MAXIMUM SERVICES AND STORAGE RATES, AND MINIMUM INSURANCE REQUIREMENTS; RECORDS; PENALTIES; SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.

 

1.         Copies of this Notice and the proposed ordinance are available for inspection or copying during regular business hours at the Minutes Office of the Clerk of Courts of Lee County, located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.  Interested parties may appear at the meeting in person or through counsel, and be heard with respect to the adoption of the proposed ordinance.


2.         Anyone wishing to appeal the Board’s decision(s) with respect to any matter considered at this meeting will need a record of the proceedings.  Generally, a verbatim record, including all testimony and evidence upon which the appeal is to be based, will be necessary.
