NOTICE OF INTENT TO ADOPT A RESOLUTION
authorizing the exchange of public property
pursuant to Sec. 125.37 of the Florida Statutes
     
A public meeting will be held on September 15, 2020, at 9:30 a.m. in the Board of County Commissioners Meeting Room, in the Lee County Courthouse, 2120 Main Street, Fort Myers, Florida. At this meeting, the Board of County Commissioners will consider the exchange of public property pursuant to Florida Statutes Sec. 125.37.

The public property to be conveyed by Lee County to Estero Bay Improvement Association, Inc., is a portion of a drainage easement interest, located at 4400-4530 Estero Boulevard and 4501-4509 Bay Beach Lane, Fort Myers Beach, in Section 3, Township 47 South, Range 24 East, Lee County, being a +/-27,678 sq. ft. portion of the easement parcel described in Deed Book 285, Pages 482-483 and 533-534 of the Public Records of Lee County, Florida ("Release Area"). In addition, Lee County will provide monetary consideration in the amount of $53,847.

The property interests to be received by Lee County from Estero Bay Improvement Association Inc., a Florida not-for-profit corporation, located at 4400-4530 Estero Boulevard, in Section 3, Township 47 South, Range 24 East, Lee County, being a portion the Bay Beach common elements, and identified as follows:

1.  Drainage easement of +/-36,215 sq. ft. ("Parcels 297-DE and 297B-DE");

2.  Slope easement of +/-4,644 sq. ft. ("Parcel 297-SE");

3.  Bus/Trolley stop easement of +/-500 sq. ft. ("Parcel 297-BSE"); and

4.  Temporary construction easement of +/-55,531 sq. ft. ("Parcel 297-TCE").

Additionally, a Real Estate Exchange Agreement will be presented for approval in conjunction with the resolution to further delineate the obligations of the participating property owner for the intended transaction.

Parties to the exchange will be Lee County and Estero Bay Improvement Association, Inc., a Florida not-for-profit corporation. If the Resolution Authorizing Exchange of Property is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution and the Real Estate Exchange Agreement.

Copies of this Notice and the proposed Resolution of Exchange are available for inspection or copying during regular business hours at the Minutes Office of the Clerk of Courts of Lee County, located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida. Anyone wishing to appeal the decision made by the Board on matters considered at the meeting will need a recording of the proceedings. Generally, it will be necessary to obtain a verbatim record, including all testimony and evidence upon which the appeal is based. If the Resolution of Exchange is adopted by the Board at this meeting, it will take effect immediately.
