PLEASE BE ADVISED that on the 1st day of August, 2017, at 9:30 A.M., or as soon thereafter as may be heard, in the County Commissioner's Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida will consider and take action on the adoption of two Resolutions authorizing the exchange of public property for other real property pursuant to §125.37 of the Florida Statutes.
The public property to be conveyed by Lee County are two contiguous parcels of land located at 245 Homestead Road South, Lehigh Acres, in Section 9, Township 45 South, Range 27 East, Lee County, being the land described in the Warranty Deed dated January 25, 2017 and recorded at Instrument Number 2017000019936, of the Public Records of Lee County, Florida ("Parcel 201-Remainder A and Parcel 201-Remainder B"), consisting of 67,698 sq. ft. and 41,182 sq. ft., respectively.
The property interests to be received by Lee County from The Villages at Homestead, LLC, a Florida limited liability company, located on Homestead Road, Lehigh Acres, in Section 9, Township 45 South, Range 27 East, Lee County, being the property interests described in Instrument Number 2015000240093 and a portion of the land described in Instrument Number 2006000241110, of the Public Records of Lee County, Florida, and defined as follows:
- Fee-simple interest in Parcel 200A and 200B consisting of 62,581 sq. ft.;
- Perpetual slope easement interest in Parcel 200-PE consisting of 8,651 sq. ft.;
- Temporary Construction Easement interest in Parcel 200-TCE consisting of 474 sq. ft.; and
- Fee-simple interest in Future Right of Way Parcel consisting of 41,182 sq. ft.
Additionally, a Stipulated Final Judgment and Order to Disburse Funds and a Real Estate Exchange Agreement are requested to be approved in conjunction with the exchanges to further delineate the obligations of the participating property owner with the intended transactions.
Parties to the exchanges will be Lee County and The Villages at Homestead, LLC, a Florida limited liability company. If the Resolutions Approving Exchange of Property for Parcels 201-Remainder A and 201-Remainder B are adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution, the Stipulated Final Judgment and Order to Disburse Funds and the Real Estate Exchange Agreement.
