​PLEASE BE ADVISED that on the 2nd day of August, 2016, at 9:30 A.M., or as soon thereafter as may be heard, in the County Commissioner's Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida will consider and take action on the adoption of a Resolution authorizing the exchange of public property for other real property pursuant to §125.37 of the Florida Statutes.

The public property to be conveyed by Lee County is a parcel of land located at 39 Alabama Road North, Lehigh Acres, in Section 32, Township 44 South, Range 27 East, Lee County, being a portion of Lots 9, 10, 11 and 12, Block 1, Leeland Heights, Unit No. 1, as recorded in Plat Book 9, Page 124, of the Public Records of Lee County, Florida ("Parcel 129-Remainder"), consisting of 18,654.2 sq. ft.

The property interests to be received by Lee County from Executive Plaza Owners Association, Inc., a Florida non-profit corporation, located at 45 Alabama Road North, in Section 32, Township 44 South, Range 27 East, Lee County, being a portion of Lots 7 and 8, Block 1, Leeland Heights, Unit No. 1, as recorded in Plat Book 9, Page 124, of the Public Records of Lee County, Florida, and defined as follows: 
  1. A "Right-of-Way Parcel" consisting of 87 sq. ft. in fee-simple ("Parcel 128-PE");
  2. A "Temporary Easement Parcel" consisting of 818 sq. ft. temporary construction easement ("Parcel 128-TCE"); and
  3. Lee County will also receive additional consideration in the amount of $30,000.
Additionally, an Agreement for Exchange of Real Property is requested to be adopted in conjunction with the exchange to further delineate the obligations of the participating property owner with the intended transaction.

Parties to the exchange will be Lee County and above-referenced Executive Plaza Owners Association, Inc., a Florida non-profit corporation.  If the Resolution Approving Exchange of Property is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution and the Agreement for Exchange Real Property.
