MEETINGS RESCHEDULED DUE TO HURRICANE WILMA
School Impact Fees - The final public hearing for the school impact fee ordinance has been rescheduled to November 8th (BoCC Chambers, 5:05pm).  Copies of the school impact fee update study are available by clicking here.
 
Local Planning Agency (LPA) - The LPA meeting scheduled for October 24th was cancelled. The next meeting of the LPA will be on November 28, 2005.  To view agendas for committee meetings, go to www.lee-county.com/dcd and click on the calendar.
 
ADMINISTRATIVE CODE 13-19 (PLAT APPROVAL)
Proposed revisions to Administrative Code 13-19 (AC-13-19), Technical Requirements for Plat Approval, are scheduled to go to the Board of County Commissioners for adoption on November 22nd.  The proposed amendments are intended to:
 
1. Act as a supplement to the requirements of F.S. Chapter 177.
2. Eliminate the redundancies between F.S. Chapter 177 and AC 13-19.
3. Recognize the "local rules" so they are more readily found within the code.
4. Provide standards for submittal of surety instruments supporting final plat approval in keeping with the policies set by Risk Management and industry standards.
5. Streamline the submittal and review process applicable to subdivision plats.

COMPREHENSIVE PLAN - NEW NOTICE REQUIREMENTS
On October 11, 2005 the BoCC adopted a resolution amending Lee County Administrative Code 13-7 to expand the notice requirements of pending amendments to the Future Land Use Map.  Comprehensive Plan map amendments will now require courtesy notices be sent to surrounding property owners within 500 feet of the subject property and the properties under consideration will be posted with plan amendment signs similar to zoning signs. 
 
COMPREHENSIVE PLAN AMENDMENTS ADOPTED
On October 12, 2005 the County Commission adopted the 2004/2005 Lee Plan Amendment Cycle and the 2004 Evaluation and Appraisal Report (EAR) Sufficiency Response.  The 2004/2005 Amendment Cycle included eight plan amendments.  One is a new Policy 105.1.4 that specifies consideration of limiting the population exposed to coastal flooding in the Coastal High Hazard Area will now be considered during rezoning reviews as well as during the plan amendment process.  In addition the Pine Island Compromise was also adopted which will now allow the extension of agricultural uses in lieu of preserved or restored natural features to regain density in the Coastal Rural future land use category.  The EAR Sufficiency Response addressed the Department of Community Affairs (DCA) comments on the 2004 EAR and involved several issues such as population growth, transportation, and affordable housing.  A Notice of Intent for the amendment cycle and a sufficiency response for the report can be expected from the DCA before the end of the year.  Click here for information regarding both the adopted amendment cycle and the EAR Sufficiency Response.
 
LAND DEVELOPMENT CODE AMENDMENTS - COMMUNITY PLANNING AREAS - NOVEMBER PUBLIC HEARINGS
This proposal creates a new LDC Chapter 33 devoted solely to community planning areas and establishes a basic framework for the addition of other planning community regulations.  It also consolidates existing regulations applicable to the Estero Planning Community into a single Article under appropriate section headings.  This ordinance was drafted in coordination with members of the Estero Planning Council.
 
The proposed ordinance has been reviewed by the Land Development Code Advisory Committee and the Executive Regulatory Oversight Committee, who endorsed the ordinance for Board consideration.  The ordinance will be considered by the Local Planning Agency on November 28, 2005.  The proposed ordinance is scheduled to go to the Board of County Commissioners on November 8th to direct it to public hearings (first public hearing on November 11th; second public hearing on December 13th).
