PAM1996-00001 - Future Land Use Map Small Scale
Current Status - Effective
Small Scale request for a future land use map change from Suburban to Industrial Development is intended to permit the applicant to relocate its existing business (Raymond Lumber) to a more appropriate parcel which abuts an industrial park and has access to rail and an arterial (SR 78).


PAT1996-00002 - Final Order AC - 96-011 - No 1
Current Status - Effective
Amend the Future Land Use Element by including a new Policy 2.4.3 to discourage Lee Plan Map amendments in the non-urban areas in southeast Lee County by requiring additional data and analysis to be provided by the applicant. This amendment is required by the Administration Commission's Final Order No. AC-96-011.

Amend the Lee Plan Map 17 by reallocating residential acreage within Year 2010 Subdistricts 302, 303, 308, 402, 501, and 502 from Density Reduction/Groundwater Resource to Open Lands.


PAM1996-00007 - Jeffrey Freeman - East of Fiddlesticks
Current Status - Deny
Amend the Future Land Use Map to redesignate the area located to the east of Fiddlesticks west of I-75 from the Rural Land Use Category to the Suburban or Urban Community Land Use Category.


PAB1996-00008 - Conservation Lands
Current Status - Effective
Amend the Future Land Use Map to add a new conservation lands category. Amend the text of the Future Land Use Element to add a new non-urban Conservation Lands policy under Objective 1.4. The new category will identify lands which are used for conservation purposes and are not available for urban development.


PAM1996-00010 - East of Old Hickory
Current Status - Deny
Amend the Future Land Use Map series, Map 1, the Future Land Use Map, and Map 17, the Year 2010 Overlay Map, to redesignate a specified 57+ acre portion of a parcel of land located in Section 27, Township 45 South, Range 25 East from the Rural Land Use Category to the Industrial Development Land Use Category and to add industrial acres to the Year 2010 Overlay sub-district 711. The subject parcel is located to the northeast of Fiddlesticks subdivision and west of I-75.


PAB1996-00013 - Year 2010 Acreage Allocations
Current Status - Effective
Amend the Future Land Use Map Series, Maps 16, the Year 2010 Overlay Subdistricts and Map 17, the Year 2010 Overlay Map, and Future Land Use Element Policies: 1.1.1, 1.1.9, 1.3.5, 1.7.6, 2.1.3, and 2.2.2, converting the Lee Plan’s planning horizon to the year 2020, deleting current overlay sub-districts, creating new community based planning districts, and allocating land uses through the Year 2020.


PAB1996-00014 - Public Facilities
Current Status - Effective
Amend the Future Land Use Map, Map 1, to more accurately identify publicly owned lands to be reserved for existing or future public facilities.


PAM1996-00015 - Southern Intensive Development
Current Status - Effective
Amend the Future Land Use Map to redesignate the area located northwest of Six Mile Slough, south of Daniels Parkway, and east of US 41 to Future Land Use Designations which appropriately reflect the existing uses and the county's future infrastructure expenditures in the area. If industrially designated lands are recommended for redesignation, the acreage should be relocated in appropriate areas outside of the study area.


PAB1996-00016 - SWFI Airport Noise
Current Status - Withdrawn
Amend the Future Land Use Map, Map 1, Objective 1.7 Special Treatment Areas, and Policy 1.7.1, to reflect the adopted modification of the recent FAR Part 150 Noise Study, in the 1996 amendment cycle or concurrent with the DRI amendment.


PAB1996-00017 - SWFI Airport Expansion
Current Status - Withdrawn
Amend the Future Land Use Map, Map 1, to reflect the Southwest Florida International Airport expansion in the 1996 amendment cycle or concurrent with the DRI amendment.


PAT1996-00018 - Affordable Housing Density
Current Status - Deny
Initiate an amendment to review the existing densities in the urban land use categories to determine if adjustments should be made to either the standard density or bonus density caps to encourage the development of affordable housing.


PAB1996-00019 - Lehigh Commercial Study
Current Status - Effective
Amend the Lee Plan's Future Land Use Element to implement the Lehigh Acres Commercial Land Use Study (Final Report - May 1996).


PAT1996-00020 - Commercial Use in Industrial Lands
Current Status - Effective
Amend the Future Land Use Element, Policy 1.1.7, the Industrial Development category and Policy 1.3.1 the Industrial Interchange category, to further clarify the issue of commercial uses within this industrial district.


PAT1996-00021 - Eliminate the PDDO
Current Status - Effective
Amend the Lee Plan Future Land Use Element by deleting Objective 1.8 and its subsequent policies (the Planned Development District Option).


PAT1996-00022 - Interchanges Exempt from Comm-Location Standards
Current Status - Effective
Amend the Lee Plan's Future Land Use Element by deleting specific language from Policy 6.1.2(4) and by adding a new policy under Objective 1.3 Interstate Highway Interchange Areas clarifying the interchange category's compliance with commercial location standards.

Amend the Lee Plan's Future Land Use Element, Goal 7, by correcting the inadvertent omissions in the Proposed 1994 Lee Plan.


PAT1996-00024 - Petroleum Resources

Create a policy, in the Future Land Use Element under Goal 10, Objective 1, that calls for a study to determine the feasibility of oil exploration, drilling, or production in Lee County. This study shall include recommendations regarding the appropriateness of such activities within Lee County as well as guidelines under which such activities should be regulated Blasting Ordinance


PAT1996-00025 - Pine Island Commercial Uses
Current Status - Effective
Consider updating the 1989 Pine Island Commercial Study, as required by Policy 14.4.3 and initiate appropriate changes to Goal 14: Greater Pine Island.


PAT1996-00026 - Fort Myers Beach Incorporation - Vision
Current Status - Effective
Amend the Vision Statement in the Lee Plan to reflect the incorporation of Fort Myers Beach.


PAB1996-00027 - Fort Myers Beach Incorporation - Goal
Current Status - Effective
Amend the Future Land Use Map, Map 1, and Goal 16 and its subsequent objectives and policies, to reflect the effect of the incorporation of the Town of Fort Myers Beach.


PAT1996-00028 - Fort Myers Beach Incorporation - Coastal
Current Status - Effective
Amend the Conservation and Coastal Management Element's goals, objectives and policies that apply to Estero Island to reflect the effect of the incorporation of the Town of Fort Myers Beach.

Re-evaluate the size, location and square footage limitation of the commercial node established by Policy 17.1.2.


PAT1996-00030 - New Transportation Element

Initiate a plan amendment to combine the Traffic Circulation, Mass Transit, and Ports, Aviation, and Related Facilities Elements into a new Transportation Element pursuant to Florida Statutes 163.3177(6)(j) and Rule 9J-5 Section 9J-5.019.


PAT1996-00031 - LOS For Franchised or Certificated Areas

Initiate an amendment to investigate the feasibility of establishing a level of service for potable water service for existing development that is located in specific geographic areas which are contained in franchised or certificated water service areas.


PAT1996-00032 - Surface Water Management Master Plan
Current Status - Effective
Amend the Conservation and Coastal Management Element of the Lee Plan to revise the status of the Lee County Surface Water Management Master Plan. Specifically amend Policies 37.1.1. and 38.1.1. to revise the completion dates.


PAT1996-00033 - CIP Update
Current Status - Effective
Amend the Capital Improvements Element (Tables 3 & 3A) to reflect the latest adopted Capital Improvement Program.


PAT1996-00034 - Park LOS
Current Status - Effective
Analyze the Board of Commissioners commitment to the "core services" concept as reflected in the newly adopted CIP. This analysis should identify impacts upon the level of service standards contained in the various elements. Perform an analysis to determine the effects of the "core services" concept of service provision as it guides the Capital Improvements Program and the budget for parks. This analysis should result in recommendations for any amendments to the parks level of service standard.


PAT1996-00035 - Natural Resources Inventory
Current Status - Effective
Amend the Policy 77.1.1 of the Conservation and Coastal Management Element of the Lee Plan. Specifically, revise Policy 77.1.1.4.a. to acknowledge the implementation of the policy due to the development of a comprehensive natural resources inventory and to recognize the ongoing need to maintain, upgrade, and expand the inventory. Revise Policy 77.1.1.4.b. to acknowledge the development of new classifications for environmentally sensitive lands; including Outstanding Natural Systems, Strategic Habitat Conservation Areas, Regional Biodiversity Hot Spots, and Wetland Habitats of High Priority To Endangered and Threatened Species In Florida,. Delete Policy 77.1.1.4.c. as funding to implement this policy is no longer available.


PAT1996-00036 - Southern Bald Eagle Protection

Revise Objective 77.6 of the Conservation and Coastal Management Element of the Lee Plan to be consistent with Ordinance 95-02 changes to Southern Bald Eagle Protection regulations.


PAT1996-00037 - Extend Due Date for Manatee Protection Plan
Current Status - Effective
Update the target deadline for Objective 77.7 of the Conservation and Coastal Management Element of the Lee Plan and add reference to the Marina Siting Survey.


PAT1996-00038 - Greenways
Current Status - Effective
Amend the Parks, Recreation, and Open Space Element of the Lee Plan and the Conservation and Coastal Management Element of the Lee Plan to acknowledge the designation of regionally significant greenways. Add references to these greenways in new policies under Objective 60.1 and Objective 77.11. Delete Policy 77.11.4. due to the completed expenditure of the Corkscrew Regional Ecological Watershed funds generated by this policy.


PAT1996-00039 - Charlotte Harbor National Estuary Program
Current Status - Effective
Amend Objective 82.2 of the Conservation and Coastal Management Element to acknowledge Lee County's commitment to participate in the Charlotte Harbor National Estuary Program.


PAT1996-00040 - Beach and Dune Management
Current Status - Effective
Amend Objective 83.3 to indicate the adoption of and ongoing nature of the beach and dune management program.


PAT1996-00041 - West Coast Island Navigation District
Current Status - Effective
Amend Policy 94.1.2 to indicate Lee County's support of and participation with the West Coast Inland Navigation District in dredge spoil disposal.


PAT1996-00042 - Regional Harbor Bound
Current Status - Effective
Revise Policy 94.4.1 to update the county's role in the development of management standards for live-aboard vessels with the Regional Harbor Board.


PAT1996-00043 - Manufactured Housing
Current Status - No
The following issues should be addressed in the 1996 plan amendment cycle regarding the use of mobile homes or manufacture housing as affordable housing. 1. Number of Units in Service in Lee County by Land Use Category 2. Cost and Financing 3. Social variables 4. Conclusions and policy recommendations regarding the use of manufactured housing for affordable housing


PAT1996-00044 - Needs Analysis
Current Status - Effective
Conduct a needs assessment utilizing methodology provided by the Shimberg Center for Affordable Housing and develop goals, objectives, and policies that reflect these needs as well as the available funding sources, regulatory incentives, and public-private partnerships that deliver affordable housing products. Seek to integrate the findings and data included in the Consolidated Plan (HUD) and the Local Housing Assistance Plan (SHIP) so that the Lee Plan reflects and enhances these resources. Consider the inventory of mobile homes and potential homesites with regard to changed conditions and evaluate whether or not the Lee Plan provides adequate siting for this form of housing.

Amend Policy 104.3.3 of the Historic Preservation Element by extending the deadline for considering the implementation of an historic preservation property tax exemption program.

Amend the definition of Density in the Lee Plan Glossary to correct the apparent inconsistent language.


PAT1996-00047 - Definition of Freeway
Current Status - Effective
Amend the Lee Plan Traffic Circulation Element and the Lee Plan Glossary by relocating the language that defines the term Freeway from Policy 22.1.1 to the Glossary.
