Filing an Employment Discrimination Charge

1. Who may file an employment discrimination charge?

Any individual who feels that his or her employment rights have been violated may file a charge.
   
An individual or organization may also file a complaint on behalf of another individual.

 

2. Criteria for filing an employment discrimination charge:

 

A charge must meet certain criteria, depending on where it is filed.


LOCALLY (Lee County):

The employer must be located in Lee County, Florida
   
The employer must have a minimum of 6 full-time (31 hours/week or more) employees
A covered basis: race, color, sex, national origin, age (40+), disability, or retaliation
Time limit to file a charge: 300 days from the date of the alleged discrimination


STATEWIDE (Florida):

The employer must have a minimum of 15 employees
   
A covered basis: race, color, sex, national origin, age (no minimum age defined), disability, marital status, religion, or retaliation
   
Time limit to file a charge: 365 days from the date of the alleged discrimination


NATIONALLY:

The employer must have a minimum of 15 employees.
   
A covered basis: race, color, sex, national origin, age (40+), religion, disability, or retaliation
Time limit to file a charge: 300 days from the date of the alleged discrimination
