ACTION REQUESTED/PURPOSE: 

Approve award of RFP-07-02 VISITOR & CONVENTION BUREAU MARKET RESEARCH, to the proposer whose proposal was evaluated by the Evaluation Committee as being in the best interest of Lee County, Davidson-Peterson Associates, for an estimated annual expenditure of $160,000.00/per year, with a contract period of one (1) year with four (4) one-year renewal options.

WHAT ACTION ACCOMPLISHES: 

Provides Lee County with a marketing research consultant with extensive experience in the development and implementation of integrated destination marketing research studies.  Also have destination-specific expertise in advertising effectiveness, visitor profiling, occupancy studies, economic impact, visitor trend analysis, seasonal and annual forecasting, among other types of tourism research.  Ability and experience to implement research among an international audience.

ACTION REQUESTED/PURPOSE: 

Request Board execute Agreement between the Lee County Board of County Commissioners and the School Board of Lee County for the Driver’s Education Program and authorize release of $83,300.00 from the funds collected through Lee County Ordinance #02-28 Dori Slosberg Driver Safety Education Act.  Authorize Chair to execute agreement upon receipt from the School Board of Lee County.

ACTION REQUESTED/PURPOSE:  

Approve Addendum to the Construction Manager Agreement under RFQ-05-07 COUNTY-WIDE CONTINUING CONTRACT FOR CONSTRUCTION MANAGEMENT, for the project known as HOUGH STREET INTERIOR REPAIRS  to Karr Group, Inc. d/b/a Casey Construction, for a total Guaranteed Maximum Price (GMP) of $199,912.12 (includes CM Fee of $17,123.12), with a total completion time of two (2) months.  Also request that the Board approve waiving of the formal process (if needed) and authorize the use of the Direct Material Purchase Orders as provided for in the CM Agreement with Lee County, which allows the County to purchase directly from suppliers of equipment and/or materials as a cost/time saving measure.  Authorize Chairman to execute Addendum upon receipt.

ACTION REQUESTED/PURPOSE: 

Award and authorize staff to enter into a Construction Manager Agreement for RFQ-06-12 CALOOSAHATCHEE CREEKS PRESERVE, to Karr Group, Inc., d/b/a Casey Construction for the sum of six and a half (6.5%) percent of the total construction cost of the project. Further approve the Guaranteed Maximum Price (GMP) in the amount of $2,117,379.04 (includes Construction Manager (CM) fee of $129,229.71).  Also request Board approve waiving of any formal process (if needed) and authorize the use of the Direct Material Purchase Orders based on CM’s Agreement which allows the County to purchase directly from suppliers of equipment and/or material as a cost/time saving measure. Authorize Chairman to execute the Construction Management agreement upon receipt. Approve Transfer of Funds from Reserves to Parks and Recreation Operations for the Caloosahatchee Creeks Preserve project in the amount of $732,684.

Provides Construction Management services for the clearing and installation of driveways and parking areas, water retention areas, Clivus restrooms, picnic shelters, trails (no trail clearing), -2955 linear feet of boardwalks, 2316 linear feet of packed shell trail, kayak launch, picnic tables, signs, trash cans, bike racks, kiosks etc. In accordance with site plans, permits and grant requirements.

ACTION REQUESTED/PURPOSE: 

Concur with the ranking of Consultants by the Competitive Negotiations Committee for

CN-07-03 LEE COUNTY DOT, TRAFFIC DIVISION OFFICE BUILDING in the following order of ranking, and authorize contract negotiations to commence with the number one ranked firm:  (1) Architects Design Group, Inc.; (2) Christopher J. Lee Architects, Inc.; and

(3) Architecture, Inc.

Approve the utilization of the State of Florida Contract No. RFP 06/07-06, MERCHANT SERVICES (Acceptance of Credit Cards, Charge Cards, Debit Cards, and Other Electronic Payments) for Visa and MasterCard, at the rates specified in the State of Florida Pricing Schedule, the Bank of America Merchant Pricing Schedule, and the Master Card and Visa Interchange Program Schedules.  The term of the State Contract is in effect from January 1, 2007 through December 31, 2010.  Current fees are projected to reach $500,000/year County-wide.  Further authorize Chair to execute the Participation Agreement with Bank of America.

ACTION REQUESTED/PURPOSE: 

Request Board approve Change Order No. 2 for the renewal of B-04-13 WASTE TIRE PROCESSING SERVICES for the Solid Waste Division to the current contracted bidder, Modern Recycling of Florida (Contract #2753), for the amounts indicated in Exhibit B of Change Order No. 2, for a contract term of three (3) years.  This Change Order also authorizes an annual rate adjustment on the anniversary date of the agreement based on the Consumer Price Index (CPI).  Authorize Chair execute Change Order on behalf of the Board update receipt.

Approve award of Project # EX070355, the purchase of three (3) new Versalift Bucket Trucks for DOT/Traffic from Time Manufacturing Co. per the Federal General Services Administration Contract GS-30F-1024H.  The base price of each truck is $108,078.00, with $4,610.00 in contract options, $20,018.00 in non-contract options and a quantity price break of $664.00 on all options for an each price per truck of $132,042.00.  The grand total for three trucks is $396,126.00.

Approve Project # PB070361, the utilization of the Florida Sheriff’s Association Bid # 06-14-0821A for DOT/OPS for the purchase of two (2) Volvo 18 yard Dump Trucks at a price of $118,496.54 each with a grand total of $236,993.08 from General GMC Truck Sales and Service Inc. and one (1) Pot Hole Patch Truck at a price of $120,380.00 from Sun State International Trucks.  The cost breakdowns are as follows:  Volvo 18 yd. Dump Trucks with a contract price of $115,294.00, negotiated non-contract price of $2,613.00 and a FSA Administrative Fee of $589.54 for a grand total of $118,496.54 each and a Pot Hole Patch Truck with a contract price of $123,520.00 and non-contract option deduction of $3,200.00 for a grand total of $120,380.00. The Grand Total for all three vehicles is $357,373.08

Also, approve budget transfer in the amount of $169,000 from Project #406024 Roadway Beautification and amend the FY 2006/07-2010/11.

Approve Change Order (STA) No. 1 for Phase II (U.S. 41 from Littleton Road to Charlotte County Line) under CN-06-15 U.S. 41 LANDSCAPE AND IRRIGATION PROJECT FROM CHARLOTTE COUNTY LINE TO LITTLETON ROAD AND FROM JAMAICA BAY TO CORKSCREW ROAD to A. Gail Boorman & Associates, Inc., in the not-to-exceed amount of $98,952.50, bringing the project total for Phases I and II to $194,180.00.  Phase III (U.S. 41 from San Carlos Drive to Corkscrew Road) of this project will be brought back to the Board for approval.  Also, authorize Chairman to execute STA on behalf of the board.  This project was anticipated and funds are available.

This is a Developer contributed asset and the project is located on the south side of Corporate Park Circle approximately 800’ west of Plantation Road.

Implements Lee County Ordinance 02-08, prohibiting the use of outdoor ignition sources and extends the State of Local Emergency for an additional seven (7) days.

Approve and execute Partnership Agreement between Lee County and Florida Department of Agriculture and Consumer Services, Division of Forestry (DOF) for restoration activities to include thinning of slash pine trees and prescribed burning to improve the quality of wildlife habitat and return Conservation 20/20 preserves to historic conditions.
FUNDING SOURCE:

WHAT ACTION ACCOMPLISHES: 
Partnership agreement will allow restoration thinning of select pine stands on Conservation 20/20 preserves in accordance with approved Land Stewardship Plans.
