Concur with the ranking of Consultants by the Competitive Negotiations Committee for CN-07-02 RIVERDALE BRANCH LIBRARY REPLACEMENT in the following order of ranking, and authorize contract negotiations to commence with the number one ranked firm:  (1) Harvard Jolly, Inc; (2) Christopher J. Lee Architects, Inc.; and (3) Architecture, Inc.

WHAT ACTION ACCOMPLISHES: 

Provides Lee County with a Consultant to Coordinated design, production of construction documents, and construction contract administration for an approximately 7,000 s.f. interior build-out within an existing, newly constructed shopping plaza.

Will provide the County with a consultant for a continuation of environmental (site remediation) services for Wachovia.

Approve Supplemental Task Authorization No. 1 under CN-06-12 MISCELLANEOUS PROFESSIONAL SERVICES, to Pitman-Hartenstein & Associates, Inc., Contract 3596, for the Evans to Metro Connector project in the amount of $138,491.37.  Also, authorize Chairman to execute STA on behalf of the Board.  This STA was anticipated and funds are available.

WHAT ACTION ACCOMPLISHES: 

Provides preliminary design for a new local road to extend from east of Evans Avenue in the vicinity of Oak Ridge Court across the Ten Mile Canal to connect to Metro Parkway. The new road is being considered due to Lee County’s commitment to the City of Fort Myers as part of the development of the Colonial Expressway corridor to provide traffic circulation along the local road system.

MANAGEMENT RECOMMENDATION:

ACTION REQUESTED/PURPOSE:  

Approve Addendum to the Construction Manager Agreement under RFQ-05-07 COUNTY-WIDE CONTRACT FOR CONSTRUCTION MANAGEMENT, for the project known as Estero Parkway Mitigation, to Karr Group, Inc., d/b/a Casey Construction, for a Guaranteed Maximum Price (GMP) of $360,151.58 (includes CM Fee of $29,836.98).  Also request that the Board approve waiving of the formal process (if needed) and authorize the use of  Direct Material Purchase Orders as provided for in the CM agreement with Lee County, which allows the County to purchase directly from suppliers of equipment and/or material as a cost/time saving measure.  Also, authorize Chairman to execute Addendum upon receipt.  This STA was anticipated and funds are available.

WHAT ACTION ACCOMPLISHES: 

Provides Lee County with a Construction Manager for the Three Oaks Parkway Widening and Estero Parkway Extension In-Basin Mitigation, including exotic removal, filter marsh creation, berm removal and native plantings.

ACTION REQUESTED/PURPOSE:  

Approve Construction Manager Agreement under RFQ-05-07 COUNTY-WIDE CONTINUING CONTRACT FOR CONSTRUCTION MANAGEMENT to Bundschu Kraft, Inc. for the Island Park Regional Mitigation Project Phase II, for the Guaranteed Maximum Price (GMP) of $942,030.00.00 (includes CM fee of $73,800.00), with a total project completion time of twelve (12) months.  Also request that the Board approve waiving of the formal process (if needed) and authorize the use of the Direct Material Purchase Orders as provided for in the CM agreement with Lee County, which allows the County to purchase directly from suppliers of equipment and/or materials as a cost/time saving measure.  Also authorize Chairman to execute Construction Manager Agreement upon receipt.  This CM was anticipated and funds are available.

WHAT ACTION ACCOMPLISHES: 

This mitigation project establishes approximately 80 wetlands and wildlife mitigation credits in advance of Lee County DOT projects on the southern portion of the Conservation 2020 Estero Marsh Preserve.  Wetland creation and enhancement includes exotic removal, filter marsh creation and native re-planting on 160 acres of preserve.

MANAGEMENT RECOMMENDATION:

(D)

ACTION REQUESTED/PURPOSE: 

Approve Construction Manager Addendum under RFQ-05-07 COUNTY-WIDE CONTINUING CONTRACT FOR CONSTRUCTION MANAGEMENT to Bundschu Kraft, Inc., for the Mitigation at Imperial Marsh Preserve project, for the Guaranteed Maximum Price (GMP) of $258,230.00 (includes CM fee of $20,230.00), with a total project completion time of six (6) months.  Also request that the Board approve waiving of the formal process (if needed) and authorize the use of the Direct Material Purchase Orders as provided for in the CM agreement with Lee County, which allows the County to purchase directly from suppliers of equipment and/or materials as a cost/time saving measure.  Also, authorize Chairman to execute Construction Manager Addendum upon receipt.  This project was anticipated and funds are available.

WHAT ACTION ACCOMPLISHES:   

The Imperial Marsh Preserve Mitigation Project entails exotic removal on the Conservation 2020 Imperial Marsh preserve.  This project will provide wetlands and panther mitigation in accordance with South Florida Water Management District and the Army Corps of Engineers permits issued for the Corkscrew Road widening project.  Additional panther mitigation is provided in accordance with federal permits issued for the Corkscrew Curve and Estero Parkway Extension projects.

MANAGEMENT RECOMMENDATION:

(E)

ACTION REQUESTED/PURPOSE: 

Approve award of Formal Quotation No. Q-060681Landscape Maintenance for DOT Roadways – Estero Parkway, Cypress Lake Dr., Livingston Rd., Bayshore & I-75 Interchange & Lee Blvd. for the Department of Transportation - Operations, to the low quoters per sections meeting  specifications, Greenwerx Groundskeeping, Inc. and P & T Lawn & Tractor Service at the prices listed on the attached Lee County Tabulation Sheet.  The initial term of this quote is one year; also request authority to renew this quote for four additional one-year periods, at the same terms and conditions, if in the best interest of Lee County; and to exercise the price escalator clause as per the specifications on an as-needed basis.  Funding will come from the individual department or division’s budget whom will be responsible for monitoring their individual expenditures.  DOT estimates spending approximately $125,000 annually for maintenance. Also, request authority to add and delete, through negotiation, locations as determined by DOT and Purchasing on an as needed basis and expend the funds as necessary.

WHAT ACTION ACCOMPLISHES: 

Provides DOT with two vendors to do the maintenance on the roadways mentioned above.

ACTION REQUESTED/PURPOSE:  

Award B-07-03 CORKSCREW ROAD WIDENING FROM BEN HILL TO EAST OF BELLA TERRA to the lowest responsive/responsible bidder, Mitchell & Stark Construction Co., Inc., in the not-to-exceed amount of $14,966,373.91, with a project completion time of 550 calendar days.  Also, authorize Chairman to execute contract on behalf of the Board upon receipt. 

WHAT ACTION ACCOMPLISHES: 

Provides Lee County with a Contractor for the Urban reconstruction of 3.016 miles of roadway from existing 2 lane to 4 lane roadway including 3 box culverts, street lighting and utility relocations.

ACTION REQUESTED/PURPOSE:

Developer Contributed Asset: Approve construction of a water main and force main extension serving Rosarno, to provide potable water service, fire protection and sanitary sewer service to this proposed 168-unit multi-family development.  This is a Developer contributed asset project located on the west side of US 41 South approximately 1/3 of a mile south of Park Road. 

WHAT ACTION ACCOMPLISHES:

Provides adequate utility infrastructure to support development of the subject property and complies with the Lee County Utilities Operations Manual.

MANAGEMENT RECOMMENDATION:

(B)

ACTION REQUESTED/PURPOSE:

Developer Contributed Asset:  Approve final acceptance, by Resolution and recording of one Utility Easement, as a donation of a 10’’ diameter master meter and a force main connection, to provide potable water service, fire protection and sewer service to Gulf Reflections, a recently constructed multi-family residential development. This is a Developer Contributed asset project located on the west side of Pine Ridge Road approximately 1/2 of a mile south of Kelly Road.

WHAT ACTION ACCOMPLISHES:

Provides adequate utility infrastructure to support development of the subject property and complies with the Lee County Utilities Operations Manual.

MANAGEMENT RECOMMENDATION:

ACTION REQUESTED/PURPOSE:

Developer Contributed Asset:  Approve final acceptance, by Resolution and recording of one Utility Easement, as a donation of one 8” diameter master meter assembly, to provide water service and fire protection to Orange Harbor Mobile Home and RV Park, an existing mobile home and RV park. This is a Developer Contributed asset project located on the north side of State Road 80 approximately 1/2 mile east of Interstate 75.

WHAT ACTION ACCOMPLISHES:

Provides adequate utility infrastructure to support development of the subject property and complies with the Lee County Utilities Operations Manual.

WHAT ACTION ACCOMPLISHES: 

The Consultant will continue to provide professional engineering services for physical inspection of facilities, review operations for conformance to regulations, review insurance requirements, and evaluate rate and charges with Bond Covenants as necessary to prepare an annual report with evaluation and recommendations for the Lee County Utilities Water and Sewer Engineer of Record.

Board to formally adopt Ordinance at a Public Hearing revising and reclassifying that rate structure for the Lee County Local Business Tax Ordinance.

Additionally, approve the Release of Performance Bond and authorize the Chairman to sign release on behalf of the Board of County Commissioners.

Accept $15,162.79 settlement offer from Nationwide Insurance Company for property damage to Lee County roadway on Business U.S. 41 and Pondella Road caused by Clarys Sitework and Development, Inc. in a vehicle accident on February 27, 2006.                                        

WHAT ACTION ACCOMPLISHES:  

Releases Nationwide Insurance Company and Clarys Sitework and Development, Inc. from any further liability to the County for damages to Lee County property and compensates Lee County for the full amount of damages.
